PART B - REVIEW REGULATIONS TO DETERMINE
OVERWEIGHT AND OVERSIZED REPORTING REQUIREMENTS
It is DOD policy to conform to state and local laws, regulations,
ordinances, and toll authority regulations relating to vehicular size
and weight limitations and to the movement of cargo which subjects
public highway facilities or their users to unusual hazards.
You
must ensure that no vehicular movement exceeding legal size and
weight limitations or any other special movement requiring highway
permits is made over public highways unless prior permission is
obtained from the appropriate state, local, or toll authorities.
DETERMINE MOVEMENTS OF CARGO ESSENTIAL TO NATIONAL DEFENSE
When you determine that an oversized, overweight, or other special
shipment is essential to national defense and permits from state,
local, or toll authorities are required, furnish the appropriate
Military Traffic Management Command (MTMC) routing authority with the
"certification of cargo essentiality" prepared by the shipper at
least 15 days in advance of the movement.
Under no condition is the carrier to apply for permits from state,
local, or toll authorities when the oversized, overweight, or other
special cargo is recognized as essential to the national defense by
the cognizant shipper service headquarters.
Do not release such
shipments to the designated highway carriers until they have
furnished you with a written notice that all necessary permits as
arranged by MTMC have been received or that the carrier has received
notice from state, local, or toll authorities that the necessary
permits will be furnished.
You must coordinate with state, local, or toll authorities for all
oversized, overweight, or other special movements of cargo essential
to national defense.
determine the essentiality for highway movement versus the capability
If highway movement is essential to national defense, you must
immediately forward the certification of such essentiality to the
appropriate state, local, or toll authorities and arrange for
issuance of the necessary permits to the carrier.
If you cannot
certify the essentiality for highway movement based on available
information, then forward a proposed route via an alternate mode of
transportation to the shipping activity.
